By using the services beamz Interactive (“we”, “us”, “our” or “ours”) provides and our website, you are agreeing with our Terms and Conditions stated below. Failure to follow these Terms and Conditions may result in legal or technical actions not restricted to immediate suspension or termination of your account privileges. We also reserve the right to cancel inactive accounts.

Account Management & Operations

If you wish to become part of our community you must create a user account. When creating your account, you must provide accurate and complete information. You are solely responsible for the accuracy of information provided and the activity that occurs on your account including the authorization of others to use the account. You must notify us immediately of any breach of security or unauthorized use of your account.

Although we will not be liable for your losses caused by any unauthorized use of your account, you will be liable for our losses or losses of others due to such unauthorized use.

Claims, Demands and Damages

If you have a dispute with one or more other users, you release us from claims, demands and damages of every kind and nature, known and unknown, arising out of or in any way connected with any and all said disputes. If you are a resident of the state of California, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

Indemnity

You will indemnify and defend us and hold us harmless from any claim, threat, suit, proceeding, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party.

The effective date of these Terms and Conditions is March 12, 2008. We reserve the right to change these Terms and Conditions at any time, by posting amended terms on this website. Use of this website after the effective date constitutes acceptance of the amended policy. We reserve the right to apply the amended terms to the information we have already collected, subject to any legal constraints.
